Terms of Service
These are the terms every client signs with their quote. No fine print tricks — if anything here is unclear, email support@ndisadvertising.com.
30-day money-back guarantee
Not happy in your first 30 days? We refund that month's fee in full.
Add-on subscriptions — first month free
Any add-on software subscription in your quote (for example HubSpot or ClickAnalytics) is free for its first month.
Cancel anytime
No lock-in contract. Cancel by email at any time; service runs to the end of the paid period.
Ad spend is separate
Your advertising budget (Google, Meta) is paid directly to the platform and is not included in our fees.
Client Services Agreement
1. Parties and agreement
This Client Services Agreement ("Agreement") is between NDIS Advertising ("we", "us") and the client named in the quote ("you"). The Agreement is made up of these terms and the quote they are attached to. It starts when you sign and accept it online and it is approved by our marketing manager.
2. Services
We will provide the services listed in your quote. Any service, subscription, add-on or extra work that is not listed in the quote is not included and is chargeable at our current rates, and will only be added with your written (including email) approval.
3. Add-on subscriptions — first month free
Your monthly plan is billed from your first month. Where your quote includes an add-on software subscription (for example HubSpot or ClickAnalytics), the first month of that add-on subscription is provided free of charge and billing for it starts from its second month. One-off items (for example websites) are invoiced as set out in the quote.
4. 30-day money-back guarantee
If you are not satisfied, you may request a refund by emailing support@ndisadvertising.com within 30 days of your first paid monthly invoice. We will refund that month's plan fee in full. The guarantee applies once per client and does not cover advertising spend, third-party costs, or one-off work already delivered.
5. Advertising spend
Advertising spend (such as Google Ads and Meta Ads budgets) is not part of our fees. It is paid by you directly to the advertising platform using your own payment method. We do not guarantee any particular level of enquiries, participants, rankings or results.
6. Fees and payment
Fees are shown in Australian dollars and exclude GST unless stated. Invoices are payable within 7 days. We may pause services while an invoice is overdue. Prices are fixed for the services in this quote; we will give you at least 30 days' notice of any price change.
7. Cancellation
Month-to-month plans have no lock-in period. If you choose the optional 6-month contract, you receive 10% off monthly fees for committing to six months; cancelling before the six months end means the discount no longer applies and the discounted amount for months already billed becomes payable. Otherwise you may cancel at any time by emailing support@ndisadvertising.com or from your Client Hub. Services continue until the end of the billing period already paid, and no further invoices are issued. We may end the Agreement with 14 days' written notice.
8. Your responsibilities
You will provide accurate information about your business, timely access to accounts and assets we need, and approval of content when requested. You remain responsible for your NDIS registration, compliance with the NDIS Code of Conduct and Practice Standards, and the accuracy of claims about your services.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, loss of profit, revenue, participants or data, or for the performance of advertising platforms or third-party services. To the extent any liability cannot be excluded, our total liability is limited to re-supplying the services or refunding the fees you paid us in the one month before the claim. Nothing in this Agreement excludes rights you have under the Australian Consumer Law that cannot be excluded.
10. Intellectual property
Once paid in full, the creative, copy and website deliverables made for you belong to you. Advertising accounts are set up in your name where possible. We may show non-confidential work in our portfolio unless you tell us not to.
11. Confidentiality and privacy
Each party will keep the other's confidential information private. We handle personal information in line with our Privacy Policy and never use participant information for anything other than delivering your services.
12. General
This Agreement is governed by the laws of New South Wales, Australia. It replaces any earlier discussions about the services in the quote. Signing electronically has the same effect as signing on paper.
